Welcome to LuxeRx! The terms “we”, “us” and “our” refer to LuxeRx. LuxeRx operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). LuxeRx is powered by Shopify, which enables us to provide the Services to you.

The terms and conditions below, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the Services. By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy.

SECTION 1 - ACCESS, ACCOUNT, AND AI AGENTS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence.

Automated Transactions (AP2 Standards): LuxeRx supports secure, automated commerce through the Agent Payments Protocol (AP2). If you use an AI agent or automated assistant to interact with our Services:

You grant that agent the legal authority to enter into a binding purchase contract on your behalf.
Any "Intent" or "Cart" mandate cryptographically signed by your agent is considered a legally binding electronic signature.
For "Human-Not-Present" transactions, the contract is formed at the moment your agent provides a valid AP2-compliant signature to our checkout system.

SECTION 2 - OUR PRODUCTS

We have made every effort to provide an accurate representation of our products. However, colors or appearance may differ based on your device settings. All descriptions of products are subject to change at any time without notice. We reserve the right to discontinue any product at any time.

SECTION 3 - ORDERS AND REFUND POLICY

When you place an order, you are making an offer to purchase. LuxeRx reserves the right to accept or decline your order for any reason.

Returns and Refunds: All purchases made directly from www.luxerx.shop are governed by our formal Refund & Warranty Policy.

Hygiene & Safety: Due to the medical-grade nature of our products, items that have been opened or used are strictly Final Sale.
Unopened Returns: Eligible unopened items may be returned within 30 days and are subject to a 15% restocking fee.
Defects: Technical malfunctions are subject to our Video Diagnostic protocol as detailed in our Refund Policy.
Affiliate & Third-Party Purchases: Items purchased via our affiliate partners or third-party sites are subject to the specific return policies of those respective platforms. LuxeRx cannot process or intervene in returns for orders placed outside of LuxeRx.shop.

Prices are subject to change without notice. You represent and warrant that (i) the credit card information you provide is true, correct, and complete, and (ii) you are duly authorized to use such credit card for the purchase.

SECTION 5 - SHIPPING AND DELIVERY

LuxeRx is responsible for your package during transit until the carrier provides a GPS-verified delivery confirmation. Once delivered, title and risk of loss pass to you. We are not liable for carrier delays or theft (porch piracy) once a package is marked as delivered unless optional Shipping Protection was purchased.

SECTION 6 - INTELLECTUAL PROPERTY

Our Services, including trademarks, text, images, and designs, are owned by LuxeRx, its affiliates or licensors. You must not reproduce or distribute any material from the Services without our prior written consent.

SECTION 7 - THIRD-PARTY LINKS AND AFFILIATES

LuxeRx is not responsible for examining the content or accuracy of third-party sites linked through our Services. Please review third-party policies carefully before engaging in any transaction.

SECTION 8 - RELATIONSHIP WITH SHOPIFY

LuxeRx is powered by Shopify. Any sales and purchases you make are made directly with LuxeRx. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your transactions with LuxeRx.

SECTION 9 - ERRORS AND OMISSIONS

We reserve the right to correct any typographical errors, inaccuracies, or omissions and to change or update information or cancel orders if any information is inaccurate at any time without prior notice.

SECTION 10 - LIMITATION OF LIABILITY

EXCEPT AS EXPRESSLY STATED BY LUXERX, THE SERVICES AND ALL PRODUCTS ARE PROVIDED 'AS IS'. IN NO CASE SHALL LUXERX, OUR DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY CONSEQUENTIAL DAMAGES OF ANY KIND ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS PROCURED THEREIN.

SECTION 11 - GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia. You and LuxeRx consent to venue and personal jurisdiction in the courts of Tyrone, GA.

SECTION 12 - FRAUDULENT CHARGEBACKS AND PROSECUTION

Definition of Friendly Fraud: A fraudulent chargeback is defined as the act of a customer or their authorized AI agent intentionally disputing a valid transaction with their bank despite having received the goods as described. Right to Recover: LuxeRx reserves the right to recover the full amount of the transaction, plus chargeback fees ($15–$50 USD), collection costs, and reasonable attorney’s fees. Criminal Prosecution: Under Georgia Code § 16-8-3 (Theft by Deception), intentional misrepresentation of a transaction to obtain goods without payment is a crime. LuxeRx reserves the right to report confirmed fraudulent chargebacks to the Tyrone Police Department, the GBI, and the IC3. Evidence: AP2 Mandates and GPS-tagged carrier proof of delivery shall serve as conclusive evidence in any dispute.
